The Government, through the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional – “ATR/BPN”), has begun deliberations on the Draft Law (Rancangan Undang-Undang – “RUU”) on Land Administration. This Law is intended to reform the land registration system.
“This law does not merely regulate technical matters; it also has a very broad impact—whether in the context of social welfare, legal certainty, prosperity, economic competitiveness, or the prevention of maladministration related to criminal acts,” stated Dalu Agung Darmawan, Secretary General of the ATR/BPN.
The proposed regulation is expected to ensure legal certainty of land rights while simultaneously addressing overlaps among sectoral regulations through a more comprehensive and integrated land administration framework.
The RUU on Land Administration is positioned as a lex generalis in relation to Law No. 5 of 1960 on Basic Agrarian Principles (“Law 5/1960”). It is also closely linked to the development of comprehensive and accurate spatial mapping. “This needs to be finalized promptly,” he emphasized.
