The Government and Indonesia’s House of Representatives (DPR RI) are currently deliberating a Draft Bill (“Draft Bill”) on the Omnibus Law for Housing and Residential Areas, which is intended to harmonize regulations on land-use conversion. This regulation will integrate Law No. 1 of 2011 on Housing and Residential Areas (“Law 1/2011”), Law No. 20 of 2011 on Multistory Housing Unit (“Law 20/2011”), and Law No. 4 of 2016 on Public-Housing Savings (“Tapera”) into a single comprehensive law.
“This will be discussed further in a meeting, as it relates to land-use conversion,” said the Minister of Law, Supratman Andi Agtas, to Hukumonline.
The formulation of this regulation requires strict synchronization, particularly with respect to constraints in the agrarian sector. The key aspects of concern include the adjustment of Spatial Plans (Rencana Tata Ruang Wilayah - “RTRW”), as well as the protection of Agricultural Land for Sustainable Food Production (Lahan Pertanian Pangan Berkelanjutan - “LP2B”) and protected paddy field areas.
In addition, the Draft Omnibus Law on Housing and Residential Areas is also designed to respond to Indonesia’s Constitutional Court (“MK”) decision on Tapera. Previously proposed by the Government, the initiative has now been taken over by DPR RI as a parliamentary initiative and has been included in the 2026 Priority National Legislative Program (Prolegnas).
