Draft Presidential Regulation to Govern the Role of the National Police as Investigators in Labor Cases

The Indonesian National Police (“Polri”) Labor Desk will be strengthened through a Draft Presidential Regulation (“Draft Regulation”) on Labor Law Enforcement. The Draft Regulation is being prepared as an implementing regulation of the Labor Protection Law, which was enacted in early October 2026.

President of the Confederation of All Indonesian Trade Unions (“KSPSI”) Andi Gani Nena Wea stated that the Draft Regulation would strengthen the position of the Polri Labor Desk in handling labor-related cases, including its role in conducting investigations. “The Regulation will govern and strengthen the position of the Polri Labor Desk,” Andi told Hukumonline.

Currently, the Polri Labor Desk operates under the Directorate of Specific Crimes of the Criminal Investigation Agency (“Dittipidter Bareskrim”) of Polri. Director of Specific Crimes at Bareskrim Polri, Brigadier General Mohammad Irhamni, stated that the Draft Regulation would provide a legal framework for labor supervision and law enforcement, while also serving as a guideline for Polri in handling criminal offenses in the labor sector.

According to Irhamni, the Draft Regulation will also serve as the basis for developing Polri's internal technical regulations, ranging from standard operating procedures (“SOPs”) to implementation guidelines for assigned personnel.

These internal regulations will govern the primary duties and functions of investigators and Labor Desk personnel. In addition, they will establish procedures for setting up Labor Desks at the district police (Polres) level, including in newly developing regions or industrial areas.
