The House of Representatives of the Republic of Indonesia (“DPR RI”) is currently preparing Draft Bill on the Amendment to Law No. 8 of 1999 on Consumer Protection (“Law 8/1999”). One of the provisions finalizes the enforcement rights between the National Consumer Protection Agency (“BPKN”) and the Consumer Dispute Resolution Agency (“BPSK”).
“The enforcement rights are currently being considered. Whether the BPKN or the Directorate-General of Trade and Consumer Protection at the Ministry of Trade will be merged. This includes the Consumer Dispute Settlement Agency, whether it will also be merged,” said Herman Khaeron, a member of Commission VI of the DPR RI, to Hukumonline.
The drafting of regulations also addresses the structure of consumer protection agencies at the provincial level down to the district level. This includes the delegation of duties to the heads of regional governments.
“Or does the state have its own interests in establishing the structure? There needs to be extensive input regarding enforcement powers,” he said.
