ESDM Explores Regulation of Solar Power Plants Through a Presidential Regulation

The Ministry of Energy and Mineral Resources (Energi dan Sumber Daya Mineral – “ESDM”) is currently preparing a new regulation on Solar Power Plants (Pembangkit Listrik Tenaga Surya – “PLTS”). The Director General of New, Renewable Energy and Energy Conservation (Energi Baru Terbarukan dan Konservasi Energi – “EBTKE”), Eniya Listiani Dewi, stated that the formulation of this regulation is necessary to maximize the more widespread implementation of solar modules.

“This is just about to be discussed, because the implementation of PLTS will be accelerated,” Eniya explained.

Initially designed as a Regulation of the Minister of ESDM, Eniya indicated that the new regulation on PLTS may instead be issued in the form of a Presidential Regulation (Perpres). According to her, the discussion process is being carried out concurrently with the revision of Presidential Regulation No. 112 of 2022 on the Acceleration of Renewable Energy Development for Electricity Supply (“Perpres 112/2022”), and therefore remains aligned with the inclusion of new PLTS regulatory provisions.

“Because there was previously some overlap with the initiative permit under Perpres 112/2022, it will therefore be considered whether to incorporate it into the presidential regulation or not,” she added.

The new regulation is prepared to govern, among other things, general provisions, rooftop PLTS systems, PLTS for self-use, as well as PLTS cooperation mechanisms with holders of business areas and PLN.
