ESDM Prepares Several New Ministerial Regulations for CCS/CCUS

The Ministry of Energy and Mineral Resources (“ESDM”) to complement the regulations on carbon capture and storage (“CCS”) and carbon capture utilization and storage (“CCUS”) projects in the oil and gas sector.

According to Dwi Adi Nugroho, Coordinator of the Working Group on the Development of Non-Conventional Oil and Gas Work Areas at the Ministry of ESDM, these regulations serve as a complement to two previous ministerial regulations. Namely, Regulation of the Minister of ESDM No. 2 of 2023 on the Organization of Carbon Capture and Storage, as well as Carbon Capture, Utilization and Storage in Upstream Oil and Gas Business Activities (“Regulation 2/2023”) and Regulation of the Minister of ESDM No. 16 of 2024 on the Implementation of Carbon Storage Activities in Carbon Storage Permit Areas for the Purpose of Carbon Capture and Storage Activities (“Regulation 16/2024”)

“The existing regulations already accommodate two business schemes in the form of two Ministerial Regulations. However, there are still some regulations being worked on to complement these ministerial regulations,” Dwi told Hukumonline.

Dwi added that the new ministerial regulations will accommodate the provisions of several regulations, such as Government Regulation (“Regulation”) No. 28 of 2025 on the Organization of Risk-Based Business Licensing (“Regulation 28/2025”) and Regulation No. 19 of 2025 on on Types and Tariffs of Non-Tax State Revenue (“PNBP”) Applicable at the Ministry of Energy and Mineral Resources (“Regulation 19/2025”).

In addition, the new regulations will also support the implementation of Target Injection Zone Exploration Permits (“ZTI”) and Carbon Storage Operation Permits. “The new regulations will be in the form of ministerial regulations. Some are derivatives of Regulation 28/2025 and Regulation 19/2025,” he added.
