Finalization of the Draft Regulation of the Government on Restorative Justice

The Draft Regulation of the Government (“Draft Regulation”) on restorative justice is nearing finalization. The implementing regulations of Law No. 20 of 2025 on the Criminal Procedure Code (“KUHAP”) are currently being discussed by the relevant ministries and institutions.

"Draft Regulation on restorative justice concerns the mechanisms and implementation of what is regulated in the KUHAP," said Minister of Law Supratman Andi Agtas to Hukumonline.

The regulation will establish the application of penal mediation in the criminal justice system in Indonesia. Cases will be resolved outside of court through deliberation between the victim and the perpetrator with a mediator. This is to support the continuity of restorative justice after the enactment of the KUHAP.

"The implementation will be regulated in more detail in the Regulation of the Government," said Supratman.
