Finalization of the Draft Regulation of the Minister of BKPM to Replace Three Investment Regulations

The Ministry of Investment and Downstream Industry/Investment Coordinating Board (Badan Koordinasi Penanaman Modal– “ BKPM ”) is finalizing Draft Regulation of the Minister of Investment and Downstream Industry on Guidelines and Procedures for the Organization of Risk-Based Business Licensing (Penyelenggaraan Perizinan Berusaha Berbasis Risiko–“ PBBR ”) and Investment Facilities through the Online Single Submission (“ OSS ”) System (Rancangan Peraturan Menteri Investasi dan Hilirisasi“ Rapermeninveshil ”). This regulation, which serves as an omnibus regulation for the implementation of Regulation of the Government No. 28 of 2025 on the Organization of Risk-Based Business Licensing (“ PP 28/2025 ”), is scheduled to be issued in October.

“We are currently at the seventh harmonization stage and continue to update and harmonize for finalization by the end of this month,” said Head of BKPM Legal Bureau, Andre Abraham to Hukumonline.

This regulation serves as an omnibus to BKPM Regulation No. 3 of 2021 on Electronically Integrated PBBR System (“ PerBKPM 3/2021 ”), BKPM Regulation onGuidelines and Procedures for Risk-Based Business Licensing Services and Investment Facilities (“ PerBKPM 4/2021 ”), and BKPM Regulation No. 5 of 2021 on Guidelines and Procedures for the Supervision of PBBR (“ PerBKPM 5/2021 ”).

“Since it is an omnibus regulation combining three investment ministerial regulations, at least five articles are discussed daily from over 200 articles. Hopefully, everything can be completed by September,” he explained.
