Government Accelerates the Drafting of Implementing Regulations on Abandoned Land Control

The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (“ATR/BPN”) is accelerating the drafting of implementing regulations for Government Regulation No. 48 of 2025 on the Control of Abandoned Areas and Land (“PP 48/2025”). The initiative includes the simultaneous drafting of an ATR/BPN Ministerial Regulation and Technical Guidelines (“Juknis”) to address various administrative and physical challenges in land management.

Director of Land Control, Ownership, and Utilization Regulation, Ruminah, emphasized the importance of operational guidelines to support the implementation of the regulation.

“We at the Directorate of Land Regulation are currently preparing the Technical Guidelines concerning this regulation to further develop the steps for identifying abandoned land and encouraging the determination of such land as abandoned land,” she stated.

According to her, every land right not only grants authority to the rights holder but is also accompanied by an obligation to cultivate, utilize, and maintain the land in accordance with its intended purpose.

Meanwhile, Head of the Sub-Directorate of Land Use and Utilization Regulation, Pramusinto, explained that the drafting of the Technical Guidelines is being carried out concurrently with the drafting of the ATR/BPN Ministerial Regulation as the implementing regulation of PP 48/2025.

“We are currently preparing the Technical Guidelines for the Regulation and Utilization of Abandoned Land in parallel with the preparation of the ATR Ministerial Regulation as the implementing regulation of PP 48/2025,” he explained.

The implementing regulations will further detail the procedures for regulating abandoned land, which have now been shortened to 90 days. This procedural simplification is expected to accelerate the provision of State General Land Reserves (Tanah Cadangan Umum Negara –“TCUN”) for various public interests.
