Government Drafts Technical Regulations on Airspace Management

The Government is currently drafting a number of implementing regulations under Law No. 21 of 2025 on Airspace Management (“Law 21/2025”). Deputy Minister of Law Edward Omar Sharif Hiariej emphasized the need to prepare a Draft Regulation of the Government (Rancangan Peraturan Pemerintah - “RPP”) and a Draft Regulation of the President (Rancangan Peraturan Presiden - “Rperpres”) to provide certainty regarding the implementation of Law 21/2025.

“What we are currently doing to ensure that this law can be effectively implemented is, quite simply, to promptly establish the necessary implementing regulations,” Eddy said.

Eddy explained that the matters to be elaborated in the implementing regulations include the vertical boundary of the sovereign airspace, extending up to 110 kilometers, as well as the governance of the Sub-Space area located at altitudes between 18 kilometers and 110 kilometers. The implementing regulations will also govern the operationalization of the Air Defense Identification Zone (“ADIZ”).

In addition, the RPP will reaffirm the investigative authority of investigators from the Indonesian Air Force (“TNI AU”). Such authority is expressly autonomous and does not fall under the coordination of the Indonesian National Police (“Polri”), including with respect to the submission of case files, which may be made directly to the public prosecutor. The implementing regulations for Law 21/2025 will also establish technical standards for the utilization of aerial vehicles, including High Altitude Platform Stations (“HAPS”) operating in the Sub-Space area.
