The Ministry of Law is finalizing a draft Regulation of the Government (“Draft Regulation”) on State Protection for Prosecutors and Their Family Members. Director of Harmonization of Laws and Regulations I Hernadi explained that this regulation will provide security and safety guarantees for prosecutors as the frontline enforcers of the law in handling high-risk cases.
“We are currently harmonizing and seeking input from relevant ministries/agencies because the direction of the regulation is clear in providing security guarantees for law enforcement officials and their families,” Hernadi told Hukumonline.
This Draft Regulation ini is also confirmed to not conflict with the provisions in Regulation of the Government No. 77 of 2019 on the Prevention of Criminal Acts of Terrorism and Protection of Investigators, Public Prosecutors, Judges, and Correctional Officers (“Regulation 77/2019”) and Regulation of the Government No. 40 of 2013 on the Implementation of Law No. 35 of 2009 on Narcotics (“Regulation 40/2013”), which regulates the protection of public prosecutors in cases of terrorism and narcotics crimes. Protection for prosecutors will be funded through the State Revenue and Expenditure Budget (Anggaran Pendapatan dan Belanja Negara/APBN).
“Further substantive review is needed to ensure alignment with the law and other regulations,” he concluded.
