Government Prepares a Number of Implementing Regulations for Regulation of the Government on KEN

The National Energy Council (Dewan Energi Nasional- “ DEN ”) has confirmed that the drafting of implementing regulations for Regulation of the Government No. 40 of 2025 (“ PP 40/2025 ”) on National Energy Policy (Kebijakan Energi Nasional- “ KEN ”) is being carried out by the government through the Ministry of Energy and Mineral Resources (“ ESDM ”). Under DEN’s supervision, the government is revising Regulation of the President No. 22 of 2017 (“ Perpres 22/2017 ”) on National Energy Master Plan (Rencana Umum Energi Nasional- “ RUEN ”).

“We have actually begun preparations. Once PP 40/2025 is established, the RUEN must be in place,” said the Secretary-General of the National Energy Council, Dadan Kusdiana, to Hukumonline.

Dadan stated that the drafting of Regulation of the President on  National Energy Master Plan (“ Reperpres on RUEN ”) will be completed by the end of this year and is expected to be issued in September next year. In addition to the RUEN, other regulations are also being prepared, including the Draft Regulation of the Minister of Energy and Mineral Resources on the Implementation of the Energy Buffer Reserve (Cadangan Penyangga Energi- “ CPE ”) and the Draft Regulation of the President on National Energy Reserve.

This regulation will consolidate the operational reserves and strategic reserves into a single regulatory framework. Dadan stated that the new regulation will amend Regulation of the President on Energy Buffer Reserve issued last year.

Another regulation currently being prepared by DEN and the government is the formulation of the general plan for the energy subsector, which will cover the oil and gas (“ Migas ”) sector as well as the mineral and coal (“ Minerba ”) sector. With respect to its regulatory form, Dadan explained that this matter is still under discussion within the government.

“DEN will facilitate the preparation of the regulation; the form it will take will be discussed by the government,” he added.
