
Government Prepares New Regulations on the Cross-Border Service of Judicial Documents

The Government is currently preparing a Draft Regulation of the President (“RPerpres”) on the Ratification of the Convention of 15 November 1965 on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters (“HCCH Service Convention”). Priskila Pratita Penasthika, an academic at the Faculty of Law, University of Indonesia, explained that the Convention is one of the key instruments issued by the Hague Conference on Private International Law (“HCCH”) to regulate the mechanisms for the cross-border service of judicial and extrajudicial documents.
“The preparation of this RPerpres is important because the Service Convention facilitates the service of judicial and extrajudicial documents in cross-border civil and commercial proceedings through various methods,” Pratita told Hukumonline.
It is noted that Indonesia has issued Regulation of the President No. 98 of 2025 on the Ratification of the Statute of The Hague Conference on Private International Law (“Perpres 98/2025”). However, Indonesia’s membership will only become effective upon the completion of the administrative waiting period prescribed under HCCH procedures.
The preparation of RPerpres on the ratification of the HCCH Service Convention constitutes a further step toward strengthening Indonesia’s international cooperation in the field of private international law, while also enhancing the effectiveness of handling cross-border civil and commercial disputes.
“The issuance of the RPerpres on the Service Convention is targeted for completion by July, or by the middle of this year,” she added.
