The Government is drafting an implementing regulation following the enactment of Law No. 20 of 2025 on the Criminal Procedure Code (“New KUHAP”). One of these is a Presidential Regulation (“Perpres”) on an information technology–based criminal justice system.
“This is intended to standardize the digital system. It is still being drafted and will be completed shortly,” said Dhahana Putra, Director General of Legislation at the Ministry of Law, to Hukumonline.
The regulation will include provisions on the use of body cameras by law enforcement officers, as well as the use of electronic examination reports (Berita Acara Pemeriksaan – “BAP”) utilizing artificial intelligence (AI). These rules are intended to prevent intimidation, violence, or other misconduct by investigators during the examination process.
