
Government Proposes Expedited Industrial Design Applications under Industrial Design Law Amendment

The Government and the House of Representatives of the Republic of Indonesia (“DPR RI”) are accelerating deliberations on the amendment to Law No. 31 of 2000 (“Law 31/2000”) on Industrial Designs (“Industrial Design Draft Bill”). One of the key reforms proposed by the Government is to expedite the industrial design application process, with a targeted completion period of only 33 business days.
“Developments in technology, global trade, and the digital economy require us to update the existing framework so that our protection system becomes more adaptive and able to address the needs of designers and businesses,” said Arie Ardian Rishadi, Acting Director of Intellectual Property Law Enforcement at the Directorate General of Intellectual Property (“DJKI”) of the Ministry of Law.
In addition to streamlining the application process, DJKI is also finalizing proposed amendments to the definition and scope of industrial designs, as well as provisions governing the liability of marketplace platform providers (landlord liability). Through the Industrial Design Draft Bill, DJKI has also reiterated the importance of raising awareness among creators of the need to formally register their designs to protect national design products against unauthorized use and strengthen their competitiveness in international markets.
