Government Revises Regulation of the President on Agrarian Reform

The government has accepted a proposal from the House of Representatives (“DPR”) related to the establishment of an Agrarian Reform Implementation Agency to resolve overlapping regulations and institutions. Chief of Staff for the President Muhammad Qodari said that his office is currently discussing the revision of the Regulation of the President (“Regulation”) with relevant stakeholders.

“There is already a commitment. We are communicating the details between institutions. Because surely this must address existing rules and institutions. We are looking for the right position,” said Qodari.

Under Regulation No. 86 of 2018 on Agrarian Reform (“Regulation 86/2018”), the government formed an Agrarian Reform Team led by the Coordinating Minister for Economic Affairs to determine policies for resolving obstacles in the implementation of agrarian reform. Agrarian Reform Task Force (“GTRA”) was also formed, chaired by the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (“ATR/BPN”) to coordinate the provision of Agrarian Reform Land Objects (Tanah Objek Reforma Agraria - “TORA”) for the asset structuring at the central level.

Meanwhile, Regulation No. 62 of 2023 on Acceleration of the Implementation of Agrarian Reform (“Regulation 62/2023”) regulates GTRA at the provincial and regency/city levels. The Minister of ATR/BPN, Nusron Wahid, is open to revising the Regulation.

“Regarding institutional matters, if there is a desire to revise Regulation 62/2023 on GTRA, we also agree. It's just a matter of how the institutional framework will be regulated,” said Nusron.
