Deputy Minister of Communication and Digital (Wamenkomdigi) Nezar Patria revealed progress on several regulations under Law No. 27 of 2022 on Personal Data Protection ("PDP Law"). These include a Presidential Regulation (Perpres) and a Government Regulation Draft (RPP) that have entered the harmonization process at the Ministry of Law.
The Directorate General of Legislation (Ditjen PP) of the Ministry of Law confirmed that the harmonization meeting for the Government Regulation Draft on the Implementation of Law No. 27 of 2022 on Personal Data Protection ("PDP RPP") has been conducted.
Discussions focused on refining the implementing provisions of several key articles to ensure that the PDP RPP aligns with national digital policies and strengthens the legal basis for personal data protection.
“Some of these include Article 10(2) governing the responsibilities of personal data controllers ("Controllers"), Article 34(3) concerning the rights of data subjects ("Subjects"), and Article 48(5) discussing international cooperation in personal data protection,” said Woro Wijayanti, Senior Legal Drafter at Ditjen PP, to Hukumonline.
Komdigi aims to complete the harmonization of the Presidential Regulation on PDP by the fourth week of February. This regulation is expected to ensure legal certainty and increase public trust in personal data management.
