The General Judiciary Body (Badan Peradilan Umum– “ Badilum ”) of the Supreme Court (Mahkamah Agung– “ MA ”) is currently preparing guidelines on the enforcement of executions. This policy will be elevated from its previous status as a Decree (Surat Keputusan– “ SK ”) to a Regulation of MA.
“The schedule for the leadership meeting has been completed, and only the public consultation remains this year, as the guidelines themselves have already been implemented. However, the number of executions carried out and their resolution continue to be substantial and increase annually,” said the Director General of Badilum at the Supreme Court, Bambang Myanto, to Hukumonline.
Bambang explained that the MA has not planned to establish a new institution to handle the execution of court decisions. According to him, after discussions with the government, the most realistic option for carrying out executions is to strengthen the role of court bailiffs.
“So, rather than establishing a new institution, it is better to enhance the quality of our registrars and bailiffs,” he explained.
