Deputy for Investment Climate Development at the Ministry of Investment and Downstream Industry/Investment Coordinating Board (“BKPM”), Riyatno, stated that the Draft Regulation of the Minister of Investment and Downstream Industry which is the derivative of Regulation of the Government No. 28 of 2025 (“Regulation 28/2025”) on the Organization of Risk-Based Business Licensing (“PBBR”) will soon be ratified and will be enforced in the first week of this month.
“This regulation is almost complete, it just needs to be promulgated. The Minister has signed it and it has gone through the harmonization process at the Ministry of Law 10 to 12 times,” Riyatno told Hukumonline.
Regarding the readiness for the implementation of the fictitious positive licensing system, the pilot scheme has actually been underway since June 2025 on a phased basis. To date, several ministries and institutions have implemented it, including the Ministry of Industry, the Ministry of Manpower, the Ministry of Tourism, the Ministry of Energy and Mineral Resources, the Ministry of Agriculture, and the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency. Discussions with other ministries/institutions regarding the implementation of fictitious positive will continue to be held so that licensing can be made easier.
“Implementation is being done gradually; other sectors will follow,” he said.
Riyatno added that this regulation is expected to provide certainty regarding the ease of investment mandated in Regulation 28/2025. For example, for charging station businesses, the investment value is set at Rp 10 billion per province. Meanwhile, for activities in Special Economic Zones (KEK), there are no restrictions on Foreign Investment (“PMA”).
