The House of Representatives’ Special Committee (“Pansus”) on the Industrial Design Draft Bill (“Draft Bill”) is currently developing a mandatory disclosure scheme on the use of artificial intelligence (“AI”) in the product design process. This scheme is being developed to ensure legal certainty and establish clear boundaries between human authorship and the automated outputs of AI algorithms.
Vice Chairwoman of the Special Committee on the Industrial Design Draft Bill, Lola Nelria Oktavia, emphasized that the presence of AI technology must not eliminate the boundaries of copyright and design rights based on human creativity. “The development of this technology needs to be accommodated in regulations, but it must still be accompanied by clear boundaries between human creation and the use of AI,” said Lola.
According to her, the implementation of this declaration scheme is considered crucial during the substantive examination stage at the Directorate-General of Intellectual Property (“DJKI”). The assessment of a work’s novelty and originality will depend heavily on the extent of the declared human creative contribution, thereby preventing ownership disputes or the cancellation of registrations in the future.
