
House of Representatives Plans to Revise Electricity Law

Commission XII of the House of Representatives of the Republic of Indonesia (“DPR RI”) has revealed the need to amend Law No. 30 of 2009 on Electricity, as amended by Law No. 2 of 2022 (collectively referred to as “Law 30/2009”). The amendment will accommodate the concept of Joint Utilization of Transmission Networks (Pemanfaatan Bersama Jaringan Transmisi - “PBJT”) in the Draft Bill on New and Renewable Energy (Energi Baru dan Energi Terbarukan - “EBET” “EBET Draft Bill”).
Deputy Chair of Commission XII of DPR RI, Dony Maryadi Oekon, confirmed that Law 30/2009 will be revised if the PBJT scheme is officially regulated in the EBET Draft Bill. According to him, detailed regulations on PBJT in the EBET Draft Bill require a legal framework in Law 30/2009.
“But here (Law 30/2009) the details are not stated. With the EBET Draft Bill, the details are already there, and the legal framework will be in the Electricity Law,” said Dony, who is also the Chair of the EBET Draft Bill Working Committee, to Hukumonline.
In the remaining PBJT scheme under discussion in the EBET Draft Bill, according to Dony, it will not open the door to liberalization. PT PLN (Persero) is encouraged to focus on providing transmission networks as the key to developing EBET power plants in Indonesia.
“That is what is needed going forward. Currently, the existing infrastructure is the network. The EBET electricity industry can develop if supported by the network,” he added.
