Industrial Estates Draft Bill Would Allow Companies to Independently Develop Airports and Ports

The Ministry of Industry ("Kemenperin") has proposed that the Draft Bill on Industrial Estates ("Draft Bill") grant companies operating within industrial estates greater flexibility to independently develop and manage their own basic and supporting infrastructure.

Tri Supondy, Director General of Industrial Resilience, Regional Development, and International Industrial Access at the Ministry of Industry, stated that such independently provided infrastructure would include energy and electricity facilities, raw water supply systems, seaports, inland ports, and dedicated private airports. "This is intended to enhance the quality and efficiency of operations for tenants within industrial estates," Tri said.

Despite the proposed flexibility, Tri emphasized that the implementation of this policy would remain subject to government oversight. Companies seeking to develop such infrastructure would be required to obtain prior approval from the Minister of Industry. In addition, the proposed infrastructure development must be incorporated into the industrial estate's master plan, which must be approved by the Minister. "The technical provisions will be stipulated in a Presidential Regulation," he added.

According to the Draft Bill obtained by Hukumonline, the responsibility for providing strategic infrastructure—including dedicated ports, energy facilities, and water resources—currently rests with the Central Government. This is stipulated under Article 67 paragraph (1) letter (f), which mandates the Central Government to facilitate and/or provide national strategic infrastructure, basic infrastructure, and supporting infrastructure for Industrial Estates.
