Integrated Law Enforcement Included Among the Initial Priorities of the Draft National Intellectual Property Master Plan

The Government is currently preparing the National Intellectual Property Master Plan (Rancangan Induk Kekayaan Intelektual Nasional - “RIKIN”) for the 2027–2036 period to restructure the intellectual property ecosystem in Indonesia. Deputy Coordinating Minister for Law, Human Rights, Immigration, and Correctional Affairs, Otto Hasibuan has called for the initial phase of the policy to establish an integrated law enforcement framework to provide legal certainty and protect the domestic market from unlawful practices.

According to Otto, RIKIN needs to establish a clear distinction between civil and administrative intellectual property disputes and criminal offenses. “Not every dispute concerning a license or contract warrants criminal proceedings. Conversely, organized counterfeiting, commercial piracy, infringement on digital platforms, and the cross-border distribution of counterfeit goods must be dealt with firmly,” he said.

Otto also called for stronger coordination among law enforcement authorities, including Civil Servant Investigators (Penyidik Pegawai Negeri Sipil - “PPNS”), the police, the public prosecutors’ office, the courts, as well as ministries and agencies with supervisory functions over intellectual property. To this end, he also called on the Ministry of Law to establish standardized procedures for handling cases consistently across agencies at every stage of intellectual property enforcement, in order to prevent differences in legal interpretation and implementation.

According to Otto, such standardization should cover the securing of electronic evidence, protocols for the exchange of intelligence data, and the tracing of economic gains obtained by perpetrators from intellectual property infringements.

“Law enforcement must have a deterrent effect, while also respecting due process, the limitations and exceptions provided by law, and the interests of consumers and the public interest,” he said.
