Kemenekraf Prepares Technical Regulations on Intellectual Property Rights for AI-Based Works

The Ministry of Creative Economy (“Kemenekraf”) is currently preparing several technical regulations following the issuance of Regulation of the President No. 37 of 2026 on the Master Plan for Creative Economy (Rencana Induk Ekonomi Kreatif - “Rindekraf”) 2026–2045. One of the regulations being prepared concerns the governance of works created using Artificial Intelligence (“AI”).

“Based on Regulation of the President, we consider the adoption of AI to be limited to its role as a tool or co-creator. Therefore, intellectual property rights should remain vested in the human creator,” stated Muhammad Neil El Himam, Deputy for Digital Creativity and Technology at Kemenekraf, in an interview with Hukumonline.

To support the smooth preparation of the regulations, Neil further explained that Kemenekraf continues to coordinate with various stakeholders. “We are continuing to coordinate with the Ministry of Communication and Digital Affairs (Komdigi) regarding the AI roadmap and its ethical aspects to ensure alignment with the Draft Bill (“Draft Bill”) on Copyright,” he added.

Furthermore, he emphasized that the implementation of the Rindekraf constitutes a collaborative effort involving 22 Ministries/Agencies. “The Minister plans to issue several implementing regulations to provide greater clarity regarding the requirements and support needed by creative economy actors. We want the technical guidelines to be ready once these regulations are issued, particularly for the priority programs scheduled for the second half of this year,” he explained.
