Kemenkes Prepares Regulation on Social Security

The Ministry of Health (“ Kemenkes ”) is currently preparing a series of derivative regulations on the implementation of the National Health Insurance (Jaminan Kesehatan Nasional- “ JKN ”). This constitutes implementing regulations stemming from the revision of Regulation of the President No. 59 of 2024 on the Third Amendment to Regulation of the President No. 82 of 2018 on Health Insurance (collectively referred to as “ Perpres 82/2018 ”).

“All the derivative regulations have been prepared and are awaiting issuance. At present, we are still awaiting the signing of the Perpres,” said Azhar Jaya, Director General of Advanced Health Services, in an interview with Hukumonline.

Several provisions being prepared include the regulation of competency-based referrals, which will replace the tiered referral system, as well as the implementation of Standard Inpatient Class System (Kelas Rawat Inap Standar– “ KRIS ”). In addition, the Kemenkes is also preparing regulations regarding the mechanism for the payment of JKN claims by hospitals under the Indonesian Diagnosis Related Groups (“ iDRG ”) system, including provisions on a tariff scheme aligned with the contribution rates of the Social Security Agency (“ BPJS Kesehatan ”) for Health.
