Kemenkeu Simplifies Regulation on the Import of Gift and Emergency Goods

The Government has simplified regulation by consolidating two Regulation of the Minister of Finance (“ PMK ”) into a single new regulation. This legal instrument is encompassed in the draft Regulation of the Minister of Finance (Rancangan Peraturan Menteri Keuangan– “ RPMK ”) on the Granting of Customs and/or Excise Facilities for the Import of Gift/Grant Goods.

The Director of Communication and Guidance for Customs Service Users, Nirwala Dwi Heryanto, explained that the RPMK will replace the provisions in PMK No. 69/PMK.04/2012 (“ PMK 69/2012 ”) dan PMK No. 70/PMK.04/2012 (“ PMK 70/2012 ”) which regulate the exemption of import duty and/or excise on the import of gift/grant goods. This specifically applies to imports for the purposes of natural disaster relief as well as Public Worship, Charity, Social, or Cultural Purposes.

“This new regulation is expected to serve as a legal framework that provides certainty and efficiency in the administration of the import of grant goods, especially in emergency situations or to support social and community activities,” Nirwala stated to Hukumonline.

RPMK also regulates the exemption of import duty and/or excise on gift or grant goods originating from outside the customs areas. The goods may come from various special zones such as bonded warehouses, bonded zones, bonded exhibitions, special economic zones, free trade zones, or other areas designated by laws and regulations.

“The harmonization process is underway and is expected to be issued soon,” he said.
