Kemenkum Prepares Regulation of the Minister on Cyber Notary

The Ministry of Law is currently drafting regulation of the minister on cyber notary, or digital-based notarial services. The Director General of General Legal Administration (“Ditjen AHU”) of the Ministry of Law (“Kemenkum”), Widodo, said that the regulation will serve as an implementing regulation for the application of e-notary, which would enable notaries to perform their duties and exercise their authorities electronically through the use of information technology.

“So, all deeds will eventually be prepared digitally, including digital contractual agreements. This is currently in process,” Widodo told Hukumonline.

To establish this cyber notary ecosystem, Widodo said that his ministry is also preparing the necessary supporting infrastructure, including network systems and maintenance. One of the innovations being prepared is the storage of digital deeds and contracts through cloud storage or servers operated by Ditjen AHU. With this storage system, he said, notaries will no longer need to provide physical storage space to manually retain copies of documents.

According to Widodo, the system will also prioritize security through biometric-based identity verification, preventing a notary’s account from being accessed by other persons. “We are currently reviewing and refining the entire system. Hopefully, it can be launched this year,” he said.
