Kemenperin Prepares Regulations on the Management of Used EV Batteries

The Ministry of Industry (“Kemenperin”) has begun examining the development of regulations on extended producer responsibility (“EPR”) for the management of used electric vehicle (“EV”) batteries. This preliminary study aims to formulate a framework governing the responsibilities of relevant parties in managing, reusing, and recycling batteries at the end of their useful life.

The Director of Maritime Industry, Transportation Equipment, and Defence Equipment (“IMATAP”) at the Kemenperin, Mahardi Tunggul Wicaksono, stated that discussions on EPR remain at an early stage and are being conducted jointly with the National Economic Council (DEN). “We are indeed still at the early discussion stage with DEN to formulate the study on EPR,” Tunggul told Hukumonline.

According to Tunggul, the implementation of EPR should not be the sole responsibility of the industry. The Government needs to develop a shared responsibility framework involving various stakeholders, including DEN, the Ministry of Environment, and business actors.

Meanwhile, DEN is conducting research into electric vehicle battery management models implemented in various countries. The research focuses, among other things, on determining which parties are responsible when battery performance deteriorates, as well as establishing mechanisms to ensure that used batteries are incorporated into the battery management and recycling chain.

The findings of DEN’s research will serve as one of the Government’s considerations in formulating EPR policies for electric vehicle batteries in Indonesia.
