The government is preparing a new Draft Regulation of the President (“ Perpres ”) that will strengthen the Extended Producer Responsibility (“ EPR ”) scheme. This Perpres aims to reinforce several aspects that are currently not regulated under existing rules within the Ministry of Environment (“ KLH ”).
“This Perpres covers the aspects of Extended Producer Responsibility (EPR). At least three key aspects have not yet been addressed in the existing regulations,” explained Ujang Solihin Sidik, Coordinator of the KLH Producer Governance Working Group.
First, it will institutionalize and regulate Producer Responsibility Organizations (“ PRO ”). Second, the government will require a detailed product registration system as a key to the successful implementation of EPR, drawing on international best practices. Finally, once the PROs are operational, the government will supervise, evaluate, and oversee their performance to ensure that producer-led waste management programs are carried out effectively and meet their targets, through the PRO Supervisory Board.
“When the PROs are operational, this regulation will govern the PRO Supervisory Board,” added Ujang.
