The government continues to push forward the discussion on the revision of Law No. 14 of 2008 on Public Information Disclosure (“ UU 14/2008 ”). The Director General of Public Communication and Media (Direktur Jenderal Komunikasi Publik dan Media– “ Dirjen KPM ”) at the Ministry of Communication and Digital Affairs (“ Komdigi ”), Fifi Aleyda Yahya, stated that all public information should be made as widely accessible as possible, with only limited exceptions, in accordance with the principle of Maximum Access, Minimum Exemption (“ MALE ”).“
“Exemptions are applied only when access to the information would harm a greater public interest, or if there are other reasons as stipulated by law,” Fifi explained to Hukumonline.
Several issues are being discussed in the revision of Law 14/2008, including public information governance, potential improvements to Law 14/2008, challenges in its implementation of UU 14/2008, and resolution of information disputes, as well as the institutional structure and authority of the Information Commission.
“The academic draft has been completed since 2024 and is currently under inter-ministerial discussion,” she concluded.
