The deliberation of the Draft Bill (“ Draft Bill ”) on Civil Procedural Law is being conducted concurrently with the Draft Bill on Asset Forfeiture. Both legislative instruments are substantively interconnected and require harmonization.

“The adjustments are directed toward that. This is because asset forfeiture involves private rights, such as property and related interests,” stated Bob Hasan, a Member of Commission III of Indonesia’s House of Representatives (“ DPR RI ”), in an interview with Hukumonline.

One of the matters regulated in the Draft Bill on Civil Procedural Law is the mechanism for the forfeiture of assets derived from criminal offenses, which must be submitted to the court in order to obtain a judicial decision. In addition, the draft bill provides that any seizure must be conducted in the presence of two witnesses from the district court, as well as the sub-district head (lurah) or village head (kades).

The Draft Bill on Civil Procedural Law has been included in the 2026 priority list of the National Legislative Program (Prolegnas). The regulation has been proposed as an initiative of DPR and is being deliberated by Commission III of DPR.
