The Ministry of Marine Affairs and Fisheries (“KKP”) is preparing revisions to Regulation of the Minister of Marine Affairs and Fisheries No. 32 of 2023 on the Mandatory Implementation of the Indonesian National Standards (“SNI”) for Canned Tuna, Canned Sardines, and Canned Mackerel (“PermenKP 32/2023”). The amendments are necessary to provide a legal basis for the implementation of certification for canned products by the Marine and Fisheries Product Quality Control and Supervision Agency (Badan Pengendalian dan Pengawasan Mutu Hasil Kelautan dan Perikanan - “BPPMHKP”).
Siti Nurul Fahmi, Head of the Quality Management System Working Team at BPPMHKP, stated that the regulatory revision forms part of the preparations for implementing product certification, particularly to align the legal provisions with the functions and responsibilities of the authorised institution.
“Accordingly, the preparations we are undertaking here relate to establishing the legal basis for product certification, which requires us to revise PermenKP 32/2023,” she said.
In addition to adjusting the certification authority, the revisions to PermenKP 32/2023 will introduce several new provisions. One of these is the requirement for business units engaged in the storage or distribution of products to hold a Fish Distribution Implementation Certificate (Sertifikat Penerapan Distribusi Ikan - “SPDI”).
The Government will also introduce a mandatory halal certification clause for imported products, regulate the procedures for transferring certifications, and provide for remote inspections as an option during the first surveillance assessment where an on-site inspection is not feasible.
The draft revision to PermenKP 32/2023 has been submitted to the Legal Bureau of the KKP. The regulation is expected to be included in the KKP Regulatory Drafting Programme for 2027.
