
KKP Revises Regulations on Management of Marine Sedimentation Byproducts

The Ministry of Marine Affairs and Fisheries (“KKP”) is currently drafting the Second Amendment (“Draft Regulation”) to Regulation of the Minister of Marine Affairs and Fisheries No. 33 of 2023 on the Implementing Regulation of Regulation of the Government No. 26 Tahun 2023 (“Regulation 26/2023”) on the Management of Marine Sedimentation Byproducts, as amended by Regulation of the Minister of Marine Affairs and Fisheries No. 3 of 2025 (collectively referred to as “Regulation 33/2023”). This step follows up on the Supreme Court (“MA”) ruling that the government may no longer export sea sand.
“Because the Supreme Court ruling states that Article 10 paragraph (2), Article 10 paragraph (3) and Article 10 paragraph (4) of Regulation 26/2023 on Management of Marine Sedimentation Byproducts must first be revoked,” said Agustin Murbaningsih, Marine Services Analyst at the Directorate-General of the Management of Marine Affairs at KKP, to Hukumonline.
Based on a copy of Decision of MA No. 5/P/HUM/2025 (“Decision 5/2025”), the Panel of Judges stated that the protection and preservation of the marine environment is necessary to support the sustainability of coastal and marine ecosystems. Therefore, the commercialization of sedimentation byproducts in the sea, such as the sale of sea sand, is a hasty policy that does not consider aspects of caution.
“Given these considerations, the regulation process must be in line,” she added.
