Komdigi Drafts Internet Quota and Telecommunication Tariffs Rules

The Ministry of Communication and Digital Affairs (Kementerian Komunikasi dan Digital – “Komdigi”) is reviewing several implementing regulations following Constitutional Court Decision No. 273/PUU-XXIII/2025 (“Decision 273/2025”) concerning the issue of expired internet data quotas. One of the key measures under consideration is the revision of the implementing regulation governing the telecommunications tariff formula, internet package information standards, and the protection of unused data quotas. 

"One of the regulations currently under review for amendment is Regulation of the Minister of Communication and Informatics No. 5 of 2021 on Telecommunications Operations (“Permenkominfo 5/2021”), as the provisions on tariff formulas and regulatory oversight are contained in that regulation," said Radita Ajie, Head of the Legal Bureau of the Secretariat General of Komdigi, to Hukumonline. 

As is well known, through Decision 273/2025, the Constitutional Court held that telecommunications network and service providers are required to offer service options that ensure customers' remaining internet data quotas remain valid and available for use. The Court also directed the Government to establish minimum standards for the protection of unused data quotas, including requirements relating to transparent disclosure of information to customers, options for extending the validity period or accumulating unused data quotas, reasonable limits on any additional charges, and effective complaint handling and consumer redress mechanisms where customers suffer losses.
