The Ministry of Communication and Digital Affairs (“Komdigi”) is currently drafting an implementing regulation for Government Regulation No. 17 of 2025 on Governance of the Organization of Electronic System for Child Protection (“PP Tunas”). This regulation will set out detailed mechanisms for risk assessment, mitigation, reporting, and supervision to be undertaken by Electronic System Providers (Penyelenggara Sistem Elektronik – “PSEs”) before their services may be accessed by children.
“One of the provisions establishes a minimum user age for children at three years old, with further age categorization up to 18 years,” stated Radita Ajie, Head of Legal Bureau at Komdigi, in an interview with Hukumonline.
Based on a Draft Regulation of the Minister of Communication and Digital Affairs (“RPM”) obtained by Hukumonline, PSE will be required to conduct a self-assessment to ensure that their digital products are appropriate to the various stages of children’s growth and development. Such assessment must cover the suitability of content and service features, as well as the identification of various risks, including exposure to harmful content, interaction with unknown individuals, commercial exploitation, addiction, and threats to the protection of children’s personal data.
