
Komdigi Prepares Draft Ministerial Regulation on the New Frequency Allocation Table

The Ministry of Communication and Digital Affairs (“Komdigi”) is currently preparing a national digital infrastructure roadmap, encompassing subsea cables, data centers, fiber optic networks, as well as a roadmap for mobile broadband. One of these efforts is being carried out through the drafting of a Draft Regulation of the Minister of Communication and Digital Affairs (“Minister”) on Table of Indonesian Radio Frequency Spectrum Allocation (Rancangan Peraturan Menteri – “RPM”), as mandated under Article 5 of Regulation of the Government No. 53 of 2000 on the Use of Radio Frequency Spectrum and Satellite Orbits, as amended by Regulation of the Government No. 46 of 2021 on Postal Services, Telecommunications, and Broadcasting (collectively referred to as “PP 53/2000”).
“It is currently in progress and under discussion due to the alignment of terminology with the 2024 edition of the International Telecommunication Union (ITU) Radio Regulations, while still taking national interests into consideration,” said Nezar Patria, Vice Minister of Komdigi, to Hukumonline.
The issuance of the RPM will also revoke the provisions concerning the 300 MHz radio frequency band as stipulated in Regulation of the Minister No. 07/PER/M.KOMINFO/01/2009 on the Arrangement of Radio Frequency Bands for Wireless Broadband Services (“Permen 7/2009”), as well as Regulation of the Minister No. 31 of 2014 on the Master Plan of Radio Frequency Use for the Provision of Special Telecommunications for Analog Television Broadcasting in the Ultra High Frequency Band (“Permen 31/2014”).
It also further declare that Regulation of the Minister No. 12 of 2022 on the Table of Indonesian Radio Frequency Spectrum Allocation (“Permen 12/2022”) to be no longer in effect, including the provisions of Article 5 of Regulation of the Minister No. 18 of 2015 on the Utilization Plan of Radio Frequency Spectrum in the 350–438 MHz Radio Frequency Band (“Permen 18/2015”).
