Komdigi to Separate Regulations on Commercial Mail and Delivery Tariff

The Ministry of Communication and Digital Affairs (“Komdigi”) is currently drafting Regulation of the Minister (“Draft Regulation”) to serve as a guideline for setting delivery tariffs for goods and food via app-based two-wheeled transportation services. Deputy Minister of Communication and Digital Affairs Nezar Patria explained that his office is continuing to examine the algorithmic mechanisms used by each platform to determine the final price charged to consumers.

“The proposed guidelines cover all price-determining variables, including transparency regarding discount schemes (budget discounts), as well as the various delivery service options currently available on the apps,” Nezar told Hukumonline.

The drafting of this Regulation is mandated by Article 11, paragraph (4) of Regulation of the President No. 27 of 2026 on the Protection of the Digital Platform-Based Transportation Ecosystem (“Regulation 27/2026”), under which the government will not directly set maximum or minimum tariff as it does for passenger transportation services, but will instead develop an accountable and transparent pricing formula to be implemented by digital platforms.

Nezar explained that fare regulations for the delivery of goods and food will be separated from those for passenger transportation, as the two have different characteristics, particularly in terms of risk level and cargo weight. These provisions will also be regulated separately from Regulation of the Minister of Communication and Digital Affairs No. 8 of 2025 on Commercial Postal Services (“Regulation 8/2025”).
