Discussions on the Draft Bill to Law No. 32 of 2002 on Broadcasting (“ Draft Bill on Broadcasting ”) are ongoing at the Ministry of Communication and Digital (“ Komdigi ”). Ismail, Secretary-General of Komdigi, stated that they are still awaiting the Inventory of Issues List (Daftar Inventaris Masalah– “ DIM ”) from Commission I of Indonesia’s House of Representatives (“ DPR ”).
“Discussions are still ongoing; we are also awaiting the latest DIM from the DPR,” Ismail told Hukumonline.
The Draft Bill on Broadcasting, which was initiated over a decade ago, is no longer adequate as it does not cover digital platforms or Over-the-Top (OTT) services, thereby creating a legal vacuum and regulatory imbalances between conventional and digital media. Komdigi also proposes redefining the meaning of broadcasting in the Draft Bill on Broadcasting.
