KPPU Confirms Anti-Monopoly Bill to Be Deliberated at the Beginning of the DPR RI Session in 2026

The Business Competition Supervisory Commission (Komisi Pengawas Persaingan Usaha — “KPPU”) has confirmed that the completion of the Bill on the Amendment to Law No. 5 of 1999 (“Law 5/1999”) on the Prohibition of Monopolistic Practices and Unfair Business Competition (“Anti Monopoli Bill”) will be a top priority in 2026.

“We have already conducted follow-up discussions, and there is a commitment that in 2026 the Anti-Monopoly Bill will be finalized,” said M. Fanshurullah Asa, the Chairman of KPPU, to Hukumonline.

Fanshurullah expressed optimism that the deliberation and enactment of the Anti-Monopoly Bill can be carried out during the third session of the House of Representatives of the Republic of Indonesia (Dewan Perwakilan Rakyat Republik Indonesia — “DPR RI”) or at the beginning of 2026, with a target for completion no later than May 2026. Substantively, the Anti-Monopoly Bill will regulate the implementation of a leniency program and amend the merger notification regime from a post-merger to a pre-merger system, in order to align with the acquisition standards of the Organisation for Economic Co-operation and Development (“OECD”).

In addition, the Anti-Monopoly Bill will also contain provisions relating to the digital economy, including an expansion of the definition of market, which would enable KPPU to investigate potential collusion among Business Actors through the use of digital algorithm arrangements.

“There is a shared intention to complete it as early as February and, at the latest, by May, as we have prepared the substance thoroughly,” Fanshurullah stated.
