
LKPP Drafts Regulation on Procurement of Goods and Services Through Providers

The government is preparing the derivative regulation of Regulation of the President No. 46 of 2025 on the Second Amendment to Regulation of the President No. 16 of 2018 on Government Procurement of Goods/Services (Pengadaan Barang/Jasa - “PBJ”) (collectively referred to as “Regulation 16/2018”).
“There are approximately 14 derivative Regulations of the Agency. Some are short-term priorities, which should be issued within three months. Others are medium-term, taking around six months,” said Iwan Herniwan, the Chief Secretary of the National Public Procurement Agency (Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah - “LKPP”), to Hukumonline.
One of the amendments is Regulation of LKPP No. 12 of 2021 on Guidelines for the Implementation of Government PBJ Through Providers, as amended by Regulation of LKPP No. 4 of 2024 (collectively referred to as “PerLKPP 12/2021”). This regulation covers guidelines for the implementation of Government PBJ through providers, stages of preparation, selection of providers, contract implementation, and provider performance assessment.
One of the improvements is the selection of providers for business actors. Iwan stated that his party is still reviewing the draft and the changes to the regulation are predicted to be completed in September.
