The House of Representatives of the Republic of Indonesia (“DPR RI”) is currently preparing a Draft Bill on Gig Workers. This regulation will govern the settlement of disputes between gig workers or freelancers and business actors or employers.
“Until now, there has been a legal vacuum in regulating employment relationships in the gig sector. The Manpower Law is still based on the conventional work system and therefore does not accommodate new work models, the majority of which are based on digital platforms,” said DPR RI member Syaiful Huda.
Based on the draft obtained by Hukumonline, workers can submit a written complaint to the employer. Complaints received must be initiated and resolved through an internal complaint mechanism within 30 days from the date the complaint is filed.
The Gig Worker Draft Bill also includes several important points as efforts to protect gig workers and business actors, including clarity on the status of gig workers, a cap on net income, clarity on the duration of engagement, and transparency of algorithms.
