The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (“ATR/BPN”) is preparing a mechanism for the voluntary relinquishment of a portion of land rights by holders of right-to-use titles (“HGU”).
Andi Renald, Director of Land Rights Control, Land-Use Conversion, Islands, and Specific Regions at the Ministry of ATR/BPN, stated that this mechanism is being developed to provide legal certainty for both HGU holders and communities that have been in control of the land.
According to him, there are HGU holders who are willing to relinquish portions of land that have long been controlled by local communities. However, this process requires a clear legal basis so that the relinquishment of rights can be conducted in an orderly manner and provide certainty for all parties.
“We have identified several HGU holders who are willing to relinquish part of their land because it is occupied by the community,” said Andi.
He explained that a voluntary relinquishment mechanism could serve as one tool for resolving land tenure disputes without always having to go through lengthy legal proceedings. With such a mechanism in place, HGU holders can voluntarily relinquish part of their rights to land that meets the specified criteria.
Subsequently, the relinquished land can be reorganized and granted legal status for the benefit of the community through a land redistribution mechanism in accordance with applicable laws and regulations.
According to Andi, establishing this mechanism is crucial to ensure that the process of relinquishing rights does not give rise to new legal issues, while also providing certainty regarding the status of the land after it is relinquished from the HGU.
Thus, the mechanism for the voluntary relinquishment of a portion of an HGU is expected to serve as an alternative for resolving land tenure disputes that prioritizes mutual agreement among the parties, legal certainty, and the reorganization of land tenure for the benefit of the community.
