The Ministry of Energy and Mineral Resources (“ESDM”) is still awaiting follow-up on the formulation of technical regulations following the announcement of the Regulation of the Government on the Governance of Natural Resources (“SDA”) Commodity Exports.
“There are no implementing regulations yet,” said Director-General of Minerals and Coal Tri Winarno. He noted that no further guidance has been provided following the announcement of the Regulation of the Government.
The draft Regulation of the Government obtained by Hukumonline indicates that there are several implementing regulations, particularly regarding governance, guidance, and supervision. The draft states that governance, guidance, and supervision on the implementation of the export governance of Strategic SDA Commodities are established by the respective ministers/heads of relevant non-ministerial government agencies in accordance with their respective authorities.
Meanwhile, the classification of commodity types in the document is determined by the Ministry of Trade. Regarding the commodities covered by these new provisions, Tri confirmed that nickel is not included in the regulations.
