
Ministry of Environment Revises Rules on Producer Responsibility for Waste

The Ministry of Environment (“Ministry”) is currently revising Regulation of the Minister of Environment and Forestry (“Regulation”) No. 75 of 2019 on the Roadmap for Reduction of Waste by Producers (“Regulation 75/2019”). Susy Nurmayanti, a Senior Environmental Control Officer at the Ministry of Environment, stated that this revision is a strategic step to strengthen the implementation of the circular economy through an eco-modulation scheme.
“This ecomodulation is one of the components that will be used to determine the cost of producers’ responsibility for the waste they generate,” said Susy.
The eco-modulation scheme will be used to determine the amount of the Extended Producer Responsibility (“EPR”) payment. In the future, producers who apply the SNI Ecolabel for products with high recycled content (e.g. 80 percent) will fall into the highest grade category and thus be eligible for a larger EPR cost discount.
Another regulatory provision will require producers to take back their post-consumer products or packaging for further management. Producers, including manufacturers, brand owners, and retailers, are also required to develop a waste reduction roadmap as part of their compliance with environmental laws.
