The Ministry of Finance (“Ministry”) has finalized the Draft Regulation of the Minister of Finance ("Draft Regulation") on the Settlement of Unclaimed Goods (Barang yang Dinyatakan Tidak Dikuasai - "BTD"), State-Controlled Goods (Barang yang Dikuasai Negara - "BDN"), and State-Owned Goods (Barang yang Menjadi Milik Negara - "BMMN"). This policy will replace Regulation of the Minister of Finance No. 178/PMK.04/2019 ("Regulation 178/2019") in the administration of confiscated goods or imported goods for which customs obligations have not been fulfilled.
“The mechanism for handling BTD, BDN, and BMMN goods includes procedures for auctions, destruction, donations, and mechanisms for appealing the status of goods,” said Director-General of State Assets at the Ministry of Finance, Rionald Silaban, to Hukumonline.
Rionald emphasized the importance of transparency in procedures and strengthening the recordation and reporting system through an integrated electronic system across agencies. This includes clarifying procedures for notifying the owners of goods, the period for settling customs obligations, as well as the auction scheme and allocation of auction proceeds.
“It is still being harmonized,” he concluded.
