The government is currently harmonizing a Draft Regulation of the Minister of Finance (“PMK”) concerning the imposition of Anti-Dumping Import Duties (Bea Masuk Anti-Dumping – “BMAD”) on imports of Biaxially Oriented Polyethylene Terephthalate (“BOPET”) products. The policy is intended to restrict the imports of BOPET products from India, China, and Thailand.
“This condition forms the basis for re-imposition of BMAD, considering that the validity period of Regulation of the Minister of Finance No. 11/PMK.010/2021 (“PMK 11/2021”) has expired,” stated Nirwala Dwi Heryanto, Director of Communication and Guidance of Customs and Excise Service User at the Ministry of Finance, in an interview with Hukumonline.
Based on the findings of the Indonesian Anti-Dumping Committee, dumping practices were identified in imports of BOPET products classified under Harmonized System (“HS”) code ex 3920.62.10, ex 3920.62.91, and ex 3920.62.99 originating from India, China, and Thailand, in accordance with the 2022 Indonesian Customs Tariff Book (Buku Tarif Kepabeanan Indonesia – (BTKI”). The investigation revealed that 91% of total BOPET imports into Indonesia—equivalent to 50,877 tons—originated from countries alleged to have engaged in such dumping practices.
