The Ministry of Finance (“Kemenkeu”) will soon update the provisions related to the Destruction and Disposal of State Owned Goods (“BMN”). This fiscal instrument implements the mandate in Article 80 of Regulation of the Government No. 27 of 2014 on the Management of State/Regionally Owned Goods, as amended by Regulation of the Government No. 28 of 2020 (collectively referred to as “Regulation 27/2014”).
Head of the Legal Bureau of the Secretariat-General of the Ministry of Finance, Tio Serepina Siahaan, said that this provision also replaces Regulation of the Minister of Finance No. 83/PMK.06/2016 on Procedures for the Destruction and Disposal of BMN (“Regulation 83/2016”).
“The process is currently being harmonized and follows up on the recommendations of the Indonesian Audit Board based on its specific purpose audit in 2023,” she told Hukumonline.
One of the substantive changes in the regulation is the confirmation of provisions related to the destruction and removal of intangible assets, the expansion of regulations on the removal of BMN due to other reasons such as construction that has been permanently halted and disaster management. This also includes provisions for the settlement of removal of BMN that are subject to insurance coverage under Regulation of the Minister of Finance No. 43 of 2025 on BMN Insurance (Regulation 43/2025).
