The Ministry of Foreign Affairs (Kemlu) is currently processing revision to the Draft Bill (RUU) on the Amendment of Law No. 24 of 2000 on International Treaty (“ Law 24/2000 ”). The proposed revision has been included in the queue of the National Legislation Program (Prolegnas) at the House of Representatives (Dewan Perwakilan Rakyat– “ DPR ”), as mandated by the Decision of Constitutional Court (Mahkamah Konstitusi– “ MK ”) No. 13/PUU-XVI/2018 (“ Decision 13/2018 ”), particularly concerning the mechanism for the approval or ratification of international treaties.
“Well-informed, the latest discussion has already been included in the Prolegnas list,” said Abdul Kadir Jailani, Director General for Asia Pacific and Africa (Aspasaf) at the Ministry of Foreign Affairs, to Hukumonline.
Decision 13/2018 has prompted the revision of Law 24/2000 to accommodate new norms, particularly regarding the expansion of criteria for DPR approval as outlined in Article 10 of Law 24/2000. This is being done to ensure that treaties entered into do not harm the interests of the state or the public.
“Since the discussions have been ongoing for quite some time, it’s urgent to revise Law 24/2000 as soon as possible,” he concluded.
