Ministry of Public Works Issues Regulation on Minimum Service Standards for Toll Roads

The Ministry of Public Works (“PU”) will soon issue new regulations related to Minimum Service Standards (“SPM”) for Toll Roads. This regulation is a derivative of Regulation of the Government No. 23 of 2024 on Toll Roads (“Regulation 23/2024”), which is targeted to be issued as a Regulation of the Minister (“Regulation”) on SPM in December 2025.

“The Regulation is currently being processed and we are making further adjustments based on input from the DPR Working Committee. This is because the previous SPM still used Regulation of the Minister of Public Works No. 16/PRT/M/2014 on Minimum Service Standards for Toll Roads (“Regulation 16/2014”). So, the earliest would be by the end of this year or early 2026,” said Sony Sulaksono Wibowo, a member of the Toll Road Regulatory Agency (“BPJT”), to Hukumonline.

It is known that currently, the addition of 3,111 km of toll road sections managed by 53 companies has not been matched by an increase in human resource capacity at the BPJT to carry out optimal SPM checks. The National Road Construction Agency (“BB/BPJN”) also conducts supervision and evaluation of the accuracy of SPM data by Toll Road Business Entities (“BUJT”) in accordance with field conditions as an extension of the Ministry of PU in the region, to ensure certainty of service standards for the public.
