Ministry of Religious Affairs Discusses Revision of Zakat Law

The Ministry of Religious Affairs (“Kemenag”) is preparing to discuss the draft revision (“Draft Bill”) of Law No. 23 of 2011 on Zakar Management (“Law 23/2011”). The Director of Zakat and Waqf Empowerment at the Kemenag, Waryono Abdul Ghafur revealed that this revision is an important moment to improve the management of national zakat.

“We are currently in the process of preparing for the discussion of the Draft Bill as per the decision of the Constitutional Court (“MK”),” Waryono told Hukumonline.

As per the Judicial Review decision of MK, Decision No. 54/PUU-XXIII/2025 places the National Board of Zakat Republic of Indonesia (“Baznas”) as the main zakat management institution, supported by the Zakat Management Unit (“UPZ”) and the Zakat Agency (“LAZ”) formed by the community. The results of the revision are expected to clarify the positions and roles of the various zakat management institutions, prevent overlapping roles, and clearly regulate whether Baznas acts as a regulator, executor, or beneficiary. The revision of Law 23/2011 has been included in the long list of the National Legislation Program (Prolegnas) of the House of Representatives of the Republic of Indonesia (DPR RI) for the 2024-2029 period.

“There are still two years to prepare the Draft Bill, which means we are also drafting several ministerial regulations mandated by the law, particularly on the utilization of productive zakat,” he explained.
